eBay Listing Removed: Hazardous Items (=PS &12363 JM99916366)

Dear ciphoenix,

You recently listed the following eBay Stores listing:

160098986876 - KICK ASS 200mw 532nm Hi-Power Green LASER Pointers

The eBay Stores listing was removed because it
violated the eBay Hazardous Items policy. All fees related to this listing have been credited to your account. We also notified members who placed bids on the item that the listing has been canceled.

The sale and transportation of hazardous materials, including explosive and radioactive materials, toxic substances, and so forth, is heavily regulated by federal and state law. For this reason, listings for these items on eBay are severely restricted.

Message: I bought this item on eBay - all I did was represent it honestly.
Nothing in your literature mentions LASER pointers, and in fact, ebay has a separate category for them. I fail to see why MINE was singled out from among the hundreds of listings of WAY more powerful "discotheque" units - and as for "dangerous"; so is a silver teaspoon if not used the way it was intended.

eBay's RESPONSE:

In a message dated 4/4/2007 3:11:24 P.M. Eastern Standard Time, rswebhelp@ebay.com writes:
Dear David,

Thank you for writing eBay in regard to the removal of your LASER pointer.

Listings for LASERS with an
output of more than 5mW are generally not permitted on eBay. This includes LASER pointers, medical LASERS, industrial LASERS, and so forth. The only exceptions to this policy are club/disco/"rave" types of LASERS, which *can* be listed on eBay even if their output is greater than 5mW.

As your handheld LASER pointer is 200mW, we've removed the listing and have credited your listing fees back to your account. I have to ask that you do not relist this auction.

We thank you in advance for your cooperation, and wish you luck with your future eBay transactions.

Sincerely,

MY RESPONSE

Well, if this is the case then, you are going to have to start removing about two or three hundred listings for LASERS besides mine. I bought the LASER in question on ebay. I have other avenues to market LASERS besides eBay in order to compare it to another LASER of similar output a friend of mine ALSO bought on ebay. These items can be purchased at any store that sells telescopes, and they are NOT "hazardous" - no more "hazardous" than a kitchen knife -
if you stab yourself with a knife, is it the knife's fault? So you should also remove knives and office staplers, power tools, and everything else that's "dangerous" from your site - especially radial arm saws. Firearms are ILLEGAL to send through the mail ONLY because the government is violating the 2nd Amendment. Bans for volatile chemicals, gases, and things that can blow up, are reasonable - but what you are banning is an amplified FLASHLIGHT. Applying this "policy" and carrying it to its logical conclusion, you will be left with bed sheets, Teddy bears and Barbie dolls.

The
"disco" LASERS you speak of (above) are the things that are inherently "dangerous" - because they are designed to be used in an environment where the beams are directed more-or-less at random in a crowd of people by those who are in no condition to handle the devices. In addition, a 400mw LASER sweeping across the line of vision and even momentarily shining directly into your eye will cause irreparable damage. The "astronomy" LASERS on the other hand, are used by responsible people to aim telescopes. The ones like I had listed are designed to be mounted in a "sight clamp" (that is why there is no pocket clip on it). The beam divergence is designed so that the beam spreads just enough to be visible to the naked eye of the user as it is pointed at the sky. The divergence of the beam at just 4 feet distant from the aperture renders it harmless to humans (although it would be unpleasant and disorienting, it would probably not irreparably damage the eye.

I am an IBM-certified LASER operator who worked with LASERS ever since they were invented.
I worked with LASERS in IBM LASER printers with outputs up to 600mw, and beams whose divergence was so small that the spot was only 12" in diameter when the LASER was pointed at the MOON - so I know from whence I speak...

But let me let you go, since you have a lot of listings to delete.
People are going to be PISSED. Se La Vie'
